The Constitutional Bench of the Supreme Court has struck down the provision requiring widows to return property shares they had already legally acquired simply because they chose to remarry.
Section 214(2) of the National Civil Code, 2074, has been declared unconstitutional and void from the outset for violating women’s freedom of marriage, the right to equality, and the right to property.
This landmark decision establishes the constitutional principle that a woman’s freedom to remarry cannot be made conditional upon, or used as a basis for, taking away her legally acquired property.
Marriage is a woman’s free choice, not a condition for losing her property.
Heartfelt congratulations to all single women on this historic legal victory, and sincere appreciation to the Supreme Court for upholding equality, justice, and women’s rights.
